Terms of Service

Welcome to Tendly. These Terms of Service (“Terms”) are a contract between you and Tendly (“we”, “us”, “our”) governing your use of the Tendly mobile app and any related services (the “Service”).
Please read these Terms carefully. By downloading, accessing, or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you must have permission from a parent or legal guardian.
By using the Service, you represent that: - You meet the eligibility requirements above. - The information you provide is accurate. - Your use of the Service complies with all applicable laws.
2. Your Account
Some features require an account. You are responsible for: - Keeping your sign-in credentials secure. - All activity that occurs under your account. - Notifying us promptly at support@tendly.garden if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or to harm the Service or other users.
3. Subscriptions and Payments
Tendly Plus
The Service offers a paid subscription called Tendly Plus, available in two billing periods:
- Monthly: USD $6.99 per month
- Annual: USD $39.99 per year
Each new subscriber is eligible for a 7-day free trial of Tendly Plus. After the trial, your subscription will automatically renew at the price for the period you selected unless you cancel.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Renewal charges occur within 24 hours of the period’s end.
How to cancel
You can cancel your subscription at any time in iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period — you keep access until then.
Pricing
Prices are shown in your local currency where supported by Apple. Apple is responsible for currency conversion and applicable taxes. We may change prices for new subscribers at any time. Existing subscribers will be notified at least 30 days before any price change affects their renewals.
Refunds
All subscription purchases are processed by Apple and subject to Apple’s refund policy. Tendly does not directly issue refunds. Refund requests must be made to Apple at https://reportaproblem.apple.com.
Free tier
Without a subscription, you may use a limited free tier (currently: one plant identification and one plant added to your garden). The exact limits of the free tier may change.
4. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws.
- Upload content that infringes intellectual property, privacy, or other rights.
- Attempt to reverse-engineer, scrape, or extract data from the Service in bulk.
- Use the Service to harass, harm, or deceive others.
- Probe, scan, or test the vulnerability of any system or network connected to the Service without our prior written permission.
- Use any automated system (bots, scrapers) to access the Service.
- Resell, sublicense, or commercialize the Service or your access to it.
We may remove content or suspend access at our discretion if we reasonably believe these rules have been violated.
5. Your Content
The Service lets you upload photos, notes, and other content (collectively, “Your Content”).
- You own Your Content. You retain all rights you had in Your Content before uploading it.
- License to operate the Service. You grant Tendly a worldwide, non-exclusive, royalty-free license to process, store, transmit, and display Your Content solely for the purpose of operating the Service for you (e.g., sending your plant photo to our identification provider, storing your garden log).
- This license ends when you delete Your Content or terminate your account, subject to backup retention periods.
You represent that you have all rights necessary to upload Your Content and that doing so does not violate any third party’s rights.
6. Plant Identification and Care Advice
Tendly provides plant identification and care recommendations through machine learning models and third-party services. This information is for educational purposes only. We do not guarantee:
- That identifications are accurate. AI models can be wrong, especially for visually similar species, immature specimens, or low-quality photos.
- That care recommendations will keep your plants alive. Plants depend on many local factors we can’t observe.
- That diagnoses of plant diseases or pests are correct. Do not rely on Tendly for decisions that could harm humans, animals, or the environment (for example, identification of edible vs poisonous plants, or selection of pesticides).
When in doubt, consult a qualified horticulturist, agronomist, or veterinarian.
7. Affiliate Links and Third-Party Purchases
Tendly may include links to third-party retailers (Home Depot, Amazon, Lowe’s, Walmart, and others) for products we recommend. Purchases from those retailers are entirely between you and the retailer — Tendly is not a party to those transactions.
We may earn an affiliate commission when you purchase via these links. This does not affect the price you pay and does not influence which products we recommend.
8. Intellectual Property
The Service — including software, design, logos, and content we create — is owned by Tendly and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.
You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.
9. Third-Party Services
The Service incorporates components from third parties (including Kindwise/Plant.id, Apple, Supabase, and others — see our Privacy Policy). Your use of these components may be subject to additional terms set by their providers.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.
We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Tendly’s total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, plants, profits, or business opportunities.
Some jurisdictions don’t allow exclusion of certain warranties or limitations of liability — in those jurisdictions our liability is limited to the smallest extent permitted by law.
12. Termination
You may stop using the Service at any time by deleting the app and (if applicable) deleting your account.
We may suspend or terminate your access if you violate these Terms, with or without notice depending on the severity. Upon termination, the rights granted to you under these Terms cease, but provisions that should reasonably survive (e.g. Sections 5, 8, 10, 11, 13, 14) will continue.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Santa Clara County, California, and you consent to personal jurisdiction in those courts. If you are a consumer in the EU or UK, this does not affect the mandatory consumer protections you may benefit from under the law of your country of residence.
14. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you in-app or by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
